These terms govern your use of Budd Xpress to browse, order, and receive delivery of adult-use cannabis products in New York State. By creating an account or placing an order, you agree to them.
Budd Xpress is restricted to adults 21 years of age and older, per New York Cannabis Law. You must confirm your date of birth before completing a purchase, and you affirm that any information you provide - including your date of birth - is accurate. An account found to belong to someone under 21 will be closed.
Budd Xpress only accepts and delivers orders to addresses within New York State. If a delivery address does not resolve to New York, we cannot complete the order.
New York law limits each order to 3 oz of flower and 24 g of concentrate. Orders that would exceed either limit will be rejected at checkout.
When you place an order, you authorize the retailer fulfilling it to charge your payment method for the order total, including any applicable New York cannabis and sales tax. You may cancel an order yourself from your account while it is still awaiting payment or paid but not yet in preparation; once a retailer has begun preparing your order, cancellation requires contacting support.
Products ordered through Budd Xpress are for your own personal, lawful use. You agree not to resell, redistribute, or otherwise provide any product ordered through Budd Xpress to any other person, and never to anyone under 21.
Budd Xpress is a technology platform, not a cannabis retailer. Each storefront on Budd Xpress is operated by, or connected to, an independent New York Office of Cannabis Management (OCM) licensed adult-use retail dispensary, and your order is fulfilled and delivered by that retailer or a licensed retail partner acting on its behalf. Budd Xpress arranges the connection between you and that retailer; the retailer is responsible for the products sold and delivered to you. Payment is processed through Stripe. Budd Xpress does not receive or store your card details - see our Privacy Policy for how payment information is handled.
You're responsible for keeping your account (and the Google account it's tied to) secure. Budd Xpress or the fulfilling retailer may refuse, cancel, or limit an order or account for a legitimate reason, including a failed age or address check, suspected fraud, or a violation of these terms.
These terms are governed by the laws of the State of New York.
We may update these terms as the service changes. Material changes will be reflected here with an updated date.
